WARNING

Motorsports are dangerous. Racing, contests of speed, and other motorsports activities must never be conducted on public roads, highways, or any areas designated for public use. Motorsports activities should only take place in controlled environments with appropriate safety precautions.

Participation in motorsports carries an inherent risk of serious injury, death, and property damage. Any person participating in motorsports assumes all associated risks. Competition Karting shall not be responsible or liable for any injury, death, loss, damage, or claims arising from participation in racing or other motorsports activities.

Many products sold by Competition Karting are intended solely for off-road, racing, track, or competition use and may not be legal for use on public roads in all jurisdictions. It is the customer’s responsibility to determine the legality, suitability, and proper application of any product purchased.

Competition Karting disclaims all express and implied warranties, including, without limitation, implied warranties of merchantability and fitness for a particular purpose. In no event shall Competition Karting be liable for any loss of profits, business interruption, loss of use, loss of data, or any indirect, incidental, special, consequential, or punitive damages arising from the use or misuse of any product sold.

Installation and Product Use

Competition Karting is not responsible for damage, injury, loss, or product failure resulting from improper installation, misuse, abuse, modification, improper maintenance, or improper application of products sold.

Professional installation is strongly recommended for all safety equipment, suspension components, braking systems, roll bars, harness bars, racing seats, fire suppression systems, and other performance products.

Pricing and Website Information

Competition Karting makes every effort to ensure the accuracy of product descriptions, pricing, availability, fitment information, images, and technical specifications. However, errors may occasionally occur.

Competition Karting reserves the right to correct pricing, inventory, product description, photographic, typographical, or other errors at any time without prior notice. Orders may be canceled and refunded in the event of any such error.

Order Acceptance and Fraud Prevention

Competition Karting reserves the right to refuse, cancel, or limit any order at its sole discretion, including but not limited to orders suspected of fraud, unauthorized transactions, pricing abuse, reseller activity, or inventory discrepancies.

Customers initiating fraudulent chargebacks or payment disputes may forfeit warranty coverage, return privileges, store credit eligibility, and future purchasing access.

Shipping Charges

Competition Karting ships most orders totaling $100.00 or more free of charge via standard ground shipping to most destinations within the contiguous United States (excluding Alaska, Hawaii, Puerto Rico, and other U.S. territories).

Most orders under $100.00 incur a flat shipping fee of $9.95 per order.

Orders shipping outside the contiguous United States, as well as orders requesting expedited shipping services, will have applicable shipping charges calculated during checkout.

Some Items Do Not Qualify for Free Shipping

Certain oversized, heavy, or specialty items will incur shipping charges regardless of order total.

Shipping Terms

Goods ordered from Competition Karting will be shipped to the address specified by the customer during checkout. While we strive to process and ship orders promptly, delivery times are estimates only and may vary due to carrier delays, weather, inventory availability, or other circumstances beyond our control.

Competition Karting shall not be liable for shipping delays, missed delivery estimates, or carrier-related service interruptions.

Risk of loss and ownership transfer to the buyer upon delivery of the shipment to the carrier.

Any shipping damage, shortages, lost packages, or delivery discrepancies must be reported to Competition Karting within 5 business days of delivery.

Expedited Shipping

Competition Karting offers a variety of expedited shipping options to help ensure timely delivery. Please note the following:

• Orders placed by 3:00 PM Central Time typically ship the same business day. Orders placed after 3:00 PM Central Time generally ship the following business day.
• Expedited shipping transit times are based on business days only and do not include the shipment date, weekends, or holidays.
• Expedited shipping transit times are estimates provided by the carrier and are not guaranteed by Competition Karting.
• If an expedited shipment is delayed due to an error by Competition Karting or the carrier, Competition Karting may, at its sole discretion, refund the expedited shipping premium paid.
• Competition Karting shall not be liable for any loss of profits, business interruption, loss of use, or consequential damages arising from shipping delays or delivery timing.

International Shipping

Competition Karting ships products worldwide to most international destinations. Certain products may be restricted from export or import depending on local laws and regulations.

Customers are responsible for ensuring that products ordered comply with all applicable laws, regulations, certifications, and import requirements in their destination country.

All import duties, taxes, surcharges, customs fees, brokerage fees, VAT, tariffs, and related charges are solely the responsibility of the buyer. Competition Karting will not pay, reimburse, refund, or credit any such charges under any circumstances.

If international duties, taxes, customs fees, brokerage fees, or related charges are refused by the buyer or recipient, Competition Karting will not issue refunds, exchanges, credits, or replacements for the order.

Returns and Non-Returnable Items

Special-order, custom-made, made-to-order, electrical, clearance, discontinued, or installed products may not be eligible for return, cancellation, exchange, or refund.

For health, safety, and product integrity reasons, certain safety equipment may not be returnable once opened, worn, installed, used, or modified, including but not limited to helmets, harnesses, underwear, and HANS devices.

Sales Tax Policy

Competition Karting collects applicable sales taxes on orders shipped to jurisdictions where we are legally required to collect and remit such taxes.

Intellectual Property

All content on this website, including but not limited to logos, graphics, text, product descriptions, photographs, videos, website design, and other materials, is the property of Competition Karting or its respective owners and may not be copied, reproduced, distributed, or used without prior written permission.

Governing Law

These Terms of Sale and any disputes arising from purchases made from Competition Karting shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Iowa, and the parties consent to the jurisdiction of such courts.
